Terms of Use

These Terms of Use constitute a legally binding agreement between SantyLink Limited (“Administrator”, “We”, “Us”, or “Our”) and any person accessing or using the SantyLink website (https://santylink.com) (“Platform”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. About the Platform

SantyLink is an e-commerce and listing platform targeting the Ugandan community. The Platform allows:

• Sellers in Uganda to advertise products through listings uploaded exclusively by the Administrator.
• Buyers to view products and directly contact sellers using provided contact details.
• Display of sourcing agents from different countries who assist with pricing, purchasing, and shipping goods to Uganda.
• Advertisement of land for sale in Uganda with details provided by landowners.

The Administrator acts solely as an intermediary and does not own, sell, manufacture, or deliver goods or land.

2. Important Disclaimers

2.1

All goods, land, and services advertised on the Platform are provided on an “as is” and “as available” basis. No warranties are made regarding quality, fitness, legality, or availability.

2.2

The Administrator does not guarantee the existence, quality, safety, legality, or accuracy of goods, land, or services, nor the ability of users to complete transactions.

2.3

Payments must only be made upon delivery. The Administrator does not collect payments and is not responsible for payments made in advance or to unauthorized individuals.

2.4

The Administrator is not responsible for mobile money errors, reversals, delays, or disputes between users.

Users are responsible for personal safety and due diligence. Meetings should take place in safe public locations during daylight hours.

3. Consumer Rights

Nothing in these Terms limits or excludes rights available under the Consumer Protection Act, 2019 or other applicable Ugandan laws.

4. Account Registration

Users may be required to create an account. Only one account per user is permitted, and users are responsible for safeguarding login credentials.

5. Sellers, Payments, and Fees

• Sellers pay a listing fee to the Administrator.
• Buyers pay sellers directly upon delivery.
• The Administrator is not an escrow agent and not a party to transactions.

6. Product Descriptions and Images

Images and descriptions are illustrative only. Minor variations may occur.

7. Sourcing Agents and Land Listings

• Sourcing agents operate independently without guarantees.
• Land listings are posted based on seller-provided information.
• Users must conduct independent legal due diligence before any land transaction.

8. User Representations and Warranties

Users confirm they are at least 18 years old, provide accurate information, comply with applicable laws, and have legal authority to sell or advertise listed items.

9. Intellectual Property Rights

Platform design, software, logos, trademarks, and branding belong to the Administrator. Ownership of goods and land remains with sellers.

10. Content Moderation and Termination

The Administrator may remove content or terminate accounts that violate these Terms or applicable law.

11. Limitation of Liability

The Administrator shall not be liable for losses or disputes arising from interactions between users.

12. Force Majeure

The Administrator is not liable for delays or failures caused by events beyond reasonable control.

13. Data Protection and Privacy

Personal data is handled in accordance with the Data Protection and Privacy Act, 2019 and the Privacy Policy.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Uganda. Disputes shall be subject to the jurisdiction of Ugandan courts.
